Senate Approves Law Introducing Guarantee Funds in Judicial Enforcement Process

Tashkent, Uzbekistan (UzDaily.com) — At the eighth plenary session of the Senate of the Oliy Majlis, lawmakers reviewed and approved the Law “On Amendments and Additions to the Law of the Republic of Uzbekistan ‘On the Enforcement of Judicial Acts and Acts of Other Bodies,’” which introduces a new legal mechanism: the use of guarantee funds in enforcement proceedings.

During the discussion, it was noted that Uzbekistan has been implementing comprehensive reforms in recent years aimed at improving the effectiveness of the judicial enforcement system. Particular focus has been placed on digitalizing procedures, minimizing human interference, and strengthening the guarantees for the strict implementation of court decisions and the protection of citizens’ property rights.

Despite the progress achieved, an analysis of enforcement practices from 2022 to 2024 revealed several challenges. Numerous enforcement documents were subject to legal disputes, and the actions of enforcement officers were often appealed. In many cases, debtors faced restrictions that complicated or entirely paralyzed their business and economic activities.

To address these issues and strike a balance between the interests of all parties involved, the new law introduces the concept of guarantee funds within enforcement proceedings. These funds serve as financial security for the enforcement of court decisions. When such guarantees are provided, enforcement actions may be temporarily suspended, and previously imposed restrictions on the debtor and their property can be lifted.

Senators emphasized that this legal innovation will become a vital instrument in strengthening the rule of law, protecting the rights and interests of citizens and businesses, and enhancing public confidence in the enforcement system.

Following the discussion, the law was approved by Senate members.
