Russia’s Supreme Court Rejects Telemarket’s Lawsuit Against Uzbekistan’s Payme Service
Tashkent, Uzbekistan (UzDaily.com) — The Supreme Court of the Russian Federation has definitively rejected a lawsuit filed by the company Telemarket against the Uzbek digital payment service Payme, the Russian Agency for Legal and Judicial Information (RAPSI) reported.
The Russian plaintiff had sought to recover 46 billion rubles (approximately 7.3 trillion Uzbek soums) from Inspired, the company behind Payme, accusing it of unlawful use of the Payme trademark. Telemarket also demanded the removal of Payme Business and Payme Uzbekistan from the Russian segment of the App Store, as well as Paymego from Google Play.
Earlier, the Moscow Arbitration Court had dismissed the claim, ruling that the applications were distributed free of charge and therefore could not be considered goods or services. The court also noted that all of Payme's commercial activity takes place exclusively within Uzbekistan and does not infringe upon the plaintiff’s intellectual property rights.
Following the lower court’s decision, Telemarket appealed to the Supreme Court, but the highest judicial authority also rejected the claims, bringing the legal dispute to a close.
