Tashkent, Uzbekistan (UzDaily.com) — At the 56th plenary session of the Senate, the Law "On amendments and additions to certain legislative acts of the Republic of Uzbekistan aimed at enhancing the powers of prosecutors in court proceedings" was discussed and approved.
The law introduces changes clarifying the principles of adversarial proceedings and expanding the powers of prosecutors. These changes aim to ensure effective protection of state interests and refine procedural norms related to the participation of prosecutors in courts handling civil, commercial, and administrative cases.
Specifically, the Law provides for:
- Prosecutors’ participation in cases related to land relations, state property, environmental protection, recovery of funds from the state budget, recognition of ownership of unauthorized constructions, determination of ownership and use of private property, and collection of customs duties.
- The right of prosecutors to file petitions with the courts in civil cases related to the protection of state interests.
- The possibility for prosecutors to request cases from the courts for review and filing protests if they were heard without proper notification of the prosecutor regarding the time and place of the hearing.
Senators emphasized that the adoption of this Law will enhance the effectiveness of the prosecutor’s office, strengthen the rule of law in case proceedings, and ensure full judicial protection of citizens' rights and freedoms, as well as the legally protected interests of society and the state. The Law was unanimously approved by the senators.
