Prosecutors granted the right to participate in courts defending state interests

Tashkent, Uzbekistan (UzDaily.com) — In Uzbekistan, prosecutors have been granted the right to participate in court proceedings concerning land relations, state property, and compensation for damages caused to the state.

On September 30, President of Uzbekistan Shavkat Mirziyoyev signed corresponding amendments to the legislation aimed at expanding the powers of prosecutors in judicial processes.

These changes are designed to strengthen the principles of adversarial proceedings, clarify procedural norms related to the participation of prosecutors, and expand their authority.

In particular, amendments were made to the Civil Procedure Code granting prosecutors the right to participate in proceedings concerning land relations, state property, compensation for damages caused to the state, and claims against the state budget.

Prosecutors are also empowered to file claims in court to defend state interests.

Changes have been made to the Economic Procedure Code, allowing prosecutors to participate in cases related to land relations, state property, violations of environmental legislation, claims against the state budget, recognition of ownership rights to unauthorized constructions, determination of ownership and use of private property, and collection of customs duties.

Additionally, prosecutors have the right to retrieve cases from the Civil, Economic, and Administrative Courts for resolving issues regarding cassation appeals or supervisory protests in cases that were reviewed without proper notification to the prosecutor about the time and place of the hearing, in which they were supposed to participate.

The procedure for appealing court decisions issued following the consideration of this category of cases has also been clarified.
