Certificates on trademarks, issued by avtor.uz, are illegal

Tashkent, Uzbekistan (UzDaily.com) -- Agency on intellectual property of Uzbekistan stated that trademarks, accepted for storage of the website www.avtor.uz and certificates, issued on them by Aston Alliance Asian Division (earlier Interbrand Marketing), are illegal and mislead entrepreneurs.
The agency said that it received appeals from business entities on trademarks, received for storage at the website www.avtor.uz and certificates, issued on them by Aston Alliance Asian Division.
In particular, the agency received appeal from pharmaceutical company Asklepy on legal force and consequences on certificates on storage of intellectual property objects.
The letter of Asklepy said that Inter Brand Marketing issued a certificate on storage of design of package Korvaltab to Neo Pass LLC.
The agency said that Tashkent Economic Court is considering appeal of Beirsdorf AG (Germany) on ending violation on use of exclusive right to NIVEA trademarks by UzGerSov and TA’LAT FAYZ BARAKA. Inter Brand Marketing issued a certificate for storage of design of package of NIVEAU to UzGerSov.
The agency noted that similar appeals were received from other business across Uzbekistan. It added that the agency reviewed the appeals on legality of certificate on intellectual property objects, issued by Inter Brand Marketing.
The agency said that the certificates are illegal and contradict to legislation of Uzbekistan. It said that the designs of the packages of the goods should be protected with copyrights only and the issue of certificates on storage of the trademark was illegal.
The Agency said that in line with the legislation only it can register trademarks to protect them. If the trademark was not registered with the agency, the trademarks will not be protected with the legislation.
The legal protection of trademarks is difficult process and the rules of the legislation should be followed, the agency said.
