Legislative Chamber hosts seminar on appeals of citizens

Legislative Chamber of Oliy Majlis of Uzbekistan and Friedrich Ebert Foundation (Germany) in Central Asia, as well as Center for Human Rights of Uzbekistan organized the event, which was attended by representatives of ministries, scientific and educational institutions, international and local experts, etc.

The seminar was aimed at discussing national legislation in consideration of appeals of legal entities, punishments for violation in this area, as well as further improvement of process of submission of appeals by citizens and legal entities to the state bodies. It was noted that article 43 of the Code on administrative responsibility and article 144 of Criminal Code do not cover issues, related to appeals of the legal entities.

The participants underlined that studying of international experience in this area is becoming actual. It was said that several countries have separate legislation for consideration of appeals of legal entities and individuals by the state bodies. Foreign experience shows that appeals of legal entities and individuals are considered within the legislative framework on administrative procedures.

Appeal of the citizens, submitted to the state bodies, is regulated with separate law in Uzbekistan – law “On appeals of the citizens”. But the law regulates only appeals of the citizens and it does not regulate appeals of the legal entities. It was aid that appeals of the legal entities are regulated by various by laws.

Today, the issues on forming legislative framework to consideration of appeals of legal entities by the state bodies became actual issues. It is necessary to form legal framework of submission of appeals in electronic form and other related issues.

During the meeting, the participants learnt experience of Bundestag (German parliament) with petitions and main regulation of the German law “On administrative procedures”. Experts shared their opinion on legislative norms of Germany, which determines legislative measures on protection of human rights, procedures of submission and consideration of appeals, terms of consideration, etc.

The participants expressed several proposals on improving legal mechanisms on consideration of appeals of individuals and legal entities by the state bodies.
