The Law “On competition” changed principles of determining dominant position and set firm criteria for dominant position in the markets. Earlier, the entities with market share of 65% or higher would be considered as domination in the market, but the law decreased threshold to 50%. In some cases, the business entities with market share between 35% and 50% can be also considered as dominant players in the market.
The State Committee of the Republic of Uzbekistan for privatization, demonopolization and development of competition will determine dominant position of the entities in the market. The dominant position will be determined in three stages.
The business entities, which offered new service in the market, will not be considered as dominant player in the market for two years.
The entities, which were acknowledged as dominant player in the market, will be included to the state registrar of the business entities, which hold dominant position in goods or financial markets.
